Staten Island man Timothy Mcvey, 41, was arrested on Wednesday for the fatal collision that killed 30-year-old Siobhan Lynch in Brooklyn last week. Police sources confirmed the charges were filed after an investigation determined the driver struck the pedestrian while she held the right of way.
The incident occurred around 6:45 p.m. on October 28 at the intersection of Bay Parkway and Cropsey Avenue in Bath Beach. Lynch was crossing from the southwest corner to the southeast corner with a green light. Mcvey, operating a Department of Sanitation New York truck, allegedly drove into her. The force of the impact threw Lynch several feet before she hit the pavement, causing severe body trauma.
Officers from the 62nd Precinct responded to the scene. Emergency medical services transported Lynch to NYU Langone Hospital-Brooklyn, where she was pronounced dead. Mcvey remained at the location following the crash.
Lynch is remembered by family and friends as a supportive aunt and twin sister. A GoFundMe page established to cover funeral costs described her as a dedicated helper who often cared for her sister’s children and assisted with family finances. Jacqueline Mariano, a friend who grew up with Lynch, posted a tribute on the fundraising site. "She listened with her entire heart and made sure you knew it," Mariano wrote. "She was the biggest nerd with an even bigger heart and a smile that truly lit up the room."
Mcvey was charged with failure to yield to a pedestrian and failure to exercise due care. Both counts are misdemeanors. If convicted, the maximum penalties include a fine of up to $250 and a jail sentence of up to 30 days.
A Sanitation Department spokesperson initially stated that the agency was assisting the NYPD with its ongoing investigation. The department did not respond to requests for comment regarding the arrest by Thursday morning.
